One Statute, Several Courthouses

Article 3 of Chapter 61 of Title 15 applies across South Carolina. A family in Anderson County has the same protections as one in Greenville County: preliminary determination, court-ordered appraisal, cotenant buyout, a preference for division and an open-market sale as the default where sale is ordered.

What differs is administrative. Each county has its own Register of Deeds and probate court, and a family whose land has passed through relatives living in different counties has records in several places. The framework is on our page covering heirs property and the Pinckney Act.

Does That Make It Harder or Just Slower?

Mostly slower, which matters because a fire-damaged building deteriorates while the work is done. It is a reason to start the record-gathering immediately rather than waiting for a decision about the property, since nothing else can proceed until it is finished. A South Carolina lawyer who does this regularly will know which offices to approach and in what order, and will finish in a fraction of the time a family would take.

Older Industrial Housing Across the Region

On tight values a full repair can approach the finished value, and that is the honest constraint on many Upstate files regardless of who owns them.

The Sections That Do Not Change By County

Article 3 of Chapter 61 of Title 15, sections 15-61-310 to 15-61-420, is state law effective 1 January 2017. Section 15-61-320 requires tenancy in common and at least 20 per cent of interests held by relatives.

Section 15-61-330 requires a preliminary determination, 15-61-360 an appraisal, 15-61-370 the cotenant buyout, and 15-61-400 an open-market sale as the default.
