Newer Housing, Simpler Deeds

Heirs' property forms when land passes through generations without a recorded transfer. Housing built in the last few decades and bought by its occupants has rarely had time to do that, and the deed usually names one or two people who are still alive.

When Would It Still Come up Here?

On the older cores. Each of these towns has streets that predate the suburban growth around them, with houses held by the same families since well before the ring cities became commuter towns. A newer address does not mean a newer house, and the Act turns on how the property was acquired rather than on the character of the town it sits in. The record settles it and checking costs nothing.

Which Municipality Holds the Property

These are separately incorporated cities with their own building departments and permitting, and Greenville County covers the unincorporated land between them.

Establishing which applies is the first practical step in any rebuild, because the answer determines who issues the permit and what a restored building has to satisfy.

Does That Affect a Sale?

Only through timing. A rebuild in one jurisdiction may move faster than in another, and a buyer pricing a project accounts for that. What matters more to a seller is that the jurisdiction question is answerable in one call, and a buyer who has not made it is pricing a schedule they have not checked.

Later Construction Decides the Repair

Much of the suburban stock uses engineered roof trusses and floor systems, which come out whole once heat has compromised the connections rather than being repaired in sections. That is a different repair route from the older housing closer in.

An engineer settles which you have, and it decides whether the property is in the repair market or the rebuild market. Buyers working from photographs assume the unfavourable answer and discount for it.

Slab Construction Is the Common Unknown

A good deal of the stock sits on a slab, and heat damage to a slab is invisible from above. It becomes the largest uncertainty on a file, which every offer deducts for.

An inspection addressing the slab specifically is worth commissioning, because uncertainty is the cheapest thing to remove from a price.

Values Usually Favour Repairing

Across much of the ring finished values carry the cost of repair comfortably, so an owner doing the work or a rehabber will beat any cash offer including ours. We say so in the written figure rather than negotiating toward it.

The Sections That Would Apply If It Did

Article 3 of Chapter 61 of Title 15 runs from section 15-61-310 to 15-61-420 and took effect on 1 January 2017. Section 15-61-320 requires tenancy in common and at least 20 per cent of interests held by relatives.

Where it applies, section 15-61-360 requires a court-ordered appraisal, section 15-61-370 gives cotenants a buyout right, and section 15-61-400 makes an open-market sale the default.
